A marital agreement, also known as a "prenuptial" or "postnuptial" agreement, is an agreement between prospective spouses, or spouses, made in contemplation of marriage or after marriage, and before filing for divorce or separation. Without a marital agreement, the family laws of the state control issues of support and property distribution upon divorce, and rights of inheritance at death. With a marital agreement, those rights, or any part of them, can be waived, established, expanded, or contracted by the parties.
